Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or otherwise using PatchForge (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and “you” refers to both you and that organization. If you do not agree to these Terms, you may not use the Service.

2. The Service

PatchForge is a multi-tenant Over-The-Air (OTA) update delivery platform for React Native applications, operated by Zimbs Technology LLP, a limited liability partnership organized under the laws of India (“Zimbs Technology LLP”, “we”, “us”, or “our”). The Service lets you package, distribute, and roll out JavaScript-bundle updates to your React Native applications without going through an app-store review cycle, together with release management, staged rollouts, and analytics tooling.

3. Accounts

Each customer operates under a single Organization, addressable at its own tenant subdomain. The person who creates the Organization (the “account owner”) is responsible for the accuracy of billing information, GST details, and payment method on file, and for the conduct of every member they invite into the Organization. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Subscription Plans & Billing

PatchForge is offered under the subscription tiers published at /pricing. Paid plans bill on a recurring basis through our payment processor, Razorpay, and applicable taxes (including GST, where applicable) are added at checkout and shown on your invoice. We may change plan pricing from time to time; where a change increases the price of your then-current plan, we will give existing subscribers at least 30 days’ notice before the new price takes effect.

5. Acceptable Use & OTA Content

You are solely responsible for the content, security, and legality of any application bundle you distribute through PatchForge. PatchForge is a distribution and delivery layer; we do not review, endorse, or take responsibility for your application code. You agree not to use the Service to distribute malware, to violate any applicable law, or to infringe the intellectual property or privacy rights of any third party. We reserve the right to suspend delivery of any bundle we reasonably believe violates this section pending review.

6. App-Store Compliance

You are solely responsible for ensuring your use of Over-The-Air updates complies with the terms of Apple’s App Store, Google Play, and any other distribution platform you publish to. Some platforms restrict what kinds of changes may be delivered outside of the normal review process. We provide general guidance in our OTA compliance guide, but you must independently verify that your usage of the Service is consistent with the policies of every store you distribute through.

7. Suspension & Termination

We may suspend or terminate your access to the Service for non-payment, following the dunning schedule disclosed in your billing settings, or where we receive a credible abuse report about content delivered through your Organization — in the latter case, we may suspend delivery pending review rather than terminating the account outright. You may cancel your subscription at any time from your billing settings; cancellation takes effect as described in your plan’s billing terms.

8. Fees & Refunds

Fees are non-refundable except as described in our Refund Policy, which includes a full-refund window for your first charge on a paid plan and a discretionary process for later requests.

9. Data & Privacy

Our collection and use of information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, and Zimbs Technology LLP will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability arising out of or relating to these Terms will not exceed the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim.

11. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in India where Zimbs Technology LLP is registered.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email to the address on file for your account before the change takes effect. Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
